My understanding is that patching always has REINSTALL set. Try "msiexec /update mypatch.msp /l*vx patch.log" and examine the properties to see what is and isn't set when you attempt to apply your patch.
Also I ask, you will never support a major upgrade? I wish I had that kind of confidence in the future.
