Hmm. Odd. This is tested by the TCK that every Tomcat release must pass so I don't think there is a bug - or if there is it is an odd edge case. I'd suggest that the way forward is to write the simplest possible test case (1 * JSP + 1 * Servlet + web.xml should be plenty) that demonstrates this issue. If you still see the issue with that test case, it will probably be time to open a bug.
