you *really* don't see the difference?

Not with respect to to the German law, which forbids "suppressing"
data.  In either case, you have "suppressed" the data.  The law
certainly does NOT say "It's OK to suppress data if you inform the
originator."

surely, it's handeled the same way as for a postmaster in the real world

he is not allowed to silent throw away a letter, but if he can't deliver it it's sent back - exactly the same happens with a rejcted message - a NDR from the sending server to his user with "undeliverable message returned to sender"

if you still don't accept the difference go out and call a laywer as others did years ago.........
