Only if you're checking for updates more than once an hour.
Repeat: ONLY if you're checking more than once an hour. They've always asked that you check less frequently than that, just to keep the servers available. All they're doing now is enforcing it.
Now, if you run 0.80 and enable the DNS-based updates for freshclam, then it only does a DNS check to see if there's a new DB. If you run *that* more than once an hour, it won't actually hit the web server unless DNS says there's an update, so there's no problem.
