AIUI, if the design spec is 3.8Ghz, that's the highest they check. Thus, chips shipped at that speed may be able to go faster, but nobody tests for it. If so, that'd mean that if you plan on overclocking, you have to start out with a top speed chip, but then, it's hard to see why you wouldn't anyway if that's your plan.
