Is "persistence.xml" under WEB-INF? I was getting the same error when I tried to avoid using the dummy persistence.xml (there is got to be a way of configuring the persistent unit from Spring, but I didn't look into it).

    xsi:schemaLocation="http://java.sun.com/xml/ns/persistence
http://java.sun.com/xml/ns/persistence/persistence_1_0.xsd";
    version="1.0">
    <persistence-unit name="punit">
    </persistence-unit>
</persistence>
