Criminy? Not really. Rather hysterical writing by 'pundits' who are stirring the pot in their own interest.
Apple has no idea where you've been. The file exists only on your phone (an in your backups of your phone). The data is not transmitted back to Apple. Furthermore, this is not GPS data, it is tower triangulation data.
AT&T on the other hand, has always! known where you are. Same for every mobile network provider.
