The problem is patents, i.e. people who didn't write the code, who have nothing to do with it telling the people who did write the code that they can't use it, distribute it etc. It's pretty silly and needs to go away, but that's a legal thing. Anyway, if you see a patent problem it's got nothing to do with closed sourceness.
