Please explain what version of Ubuntu Linux you are using or what versions of empheq, amsmath and color. Perhaps add \listfiles to your preamble and check the logfile for the versions of used files. I cannot confirm a bug because on my system using Ubuntu Linux 8.04 with texlive2007-13 it works like expected.
