The article explains why the ipw3945 driver is *so* good. The
implication is that the iwl3945 driver is *so* bad because it lacks
proprietary algorithms  from Intel. This offers no hope of improvement
in the iwl3945.

The patch for the ipw3945 driver that allows it to work under 8.04 is
reported to work. Please make it available through the channel as
restricted rights driver.

First it needs to work, if it is open source or not is a secondary
consideration.
