The patch which resolved that issue was shipped in upstream's linux-2.6.24-rc7-git5. The Ubuntu kernel then pulled in this patch for the 2.6.24-5.8 Ubuntu kernel release. I see that you are running a custom built kernel (I assume because of the b43legacy issue you had in an other bug report). I believe the boot issue you had with b43legacy should be resolved now. Care to try installing and running the latest stock ubuntu kernel, 2.6.24-8.13, and report back your results. If the issue exists, please attach your dmesg output as well as the output of 'cat /proc/version_signature' for the newer kernel.
