After investigating the response from upstream:

And following a possible solution proposed by upstream that did not work. I 
investigated the proposed long term solution and deduced that it wouldn't be 
adequate to SRU such a change when made available into libseccomp. This change 
will require massive changes not only to libseccomp but also to runc meaning 
that the regression potential is huge.

So in light of this, I have attached a patch that contains the original
solution I had back ported from upstream for libseccomp, but this time I
only back ported the fchmodat2 syscall and only for arm, aarch64, and
powerpc platforms since it was reported by @mark-elvers that ppc64le is
also affected.
