I booted the Lubuntu 18.04.4 ISO on live, and couldn't see any issues. I used `gparted` to firstly delete the sda9 partition, clicked apply. Next I created a new ext4 partition using the space without issue & rebooted
Re-ran Lubuntu 20.04 using new daily and Manual partitioning again - sda9 set for system (no format; but empty) - sda8 set for /home (no format, old non-Ubuntu data) and install this time worked.
