Do you mean is it the same bug what I described in comment #10? My comment #11 is more of a easy workaround to get the dark menus (you can easily switch between dark and light with this, as well).
Regarding comment #10, I haven't confirmed the problem with the dark user shell themes is a regression yet but it seems pretty likely that it is, since it's pretty unlikely that anyone would post a theme to www .gnome-look.org with menus that you can't read.
