Thanks for the info, I wasn't aware of what policy was for firmware. As far as I can tell this firmware is all non-free, for example it appears to come from this repo https://github.com/RPi-Distro/firmware- nonfree and be in a non-free package in debian: https://packages.debian.org/sid/firmware-brcm80211. You would have to let me know what constitutes upstream for linux-firmware.
At this time I'm just investigating why we see regular failures on some of our devices when attempting to connect to APs in our certification lab, but haven't been able to identify any cause or solid reproduction scenario as yet.
