My 2-cent contribution. After a long thought, I believe it shoud be included in multiverse, perhaps depending from a meta-package like "media-codec-ugly- multiverse", in a similar way as the "gstreamer0.10-plugins-ugly- multiverse" is done. We should consider that .ape format is quite popular, and supply the package as a migration tool to the flac format and clearly deprecate its usage as an audio compressor.
Of course, I feel uncomfortable with the custom so-called opensource licence, but it's up to the author to decide about it. As he never asked to remove or stop the mac-port project, I think he can bear with it, so I see no direct copyright infringiment.
