Well since I reported this bug I have found out that the linux-firmware
from http://mirrors.kernel.org/ubuntu/pool/main/l/linux-firmware/linux-
firmware_1.158_all.deb solved my and my sons 5GHz issue.
I ran these two commands:
wget 
http://mirrors.kernel.org/ubuntu/pool/main/l/linux-firmware/linux-firmware_1.158_all.deb
sudo dpkg -i linux-firmware_1.158_all.deb

As I stated in the forum
"http://ubuntuforums.org/showthread.php?t=2325359&page=2";

After that the wireless card has been working as  it should.
