This is reproducible in Gutsy, and very easily. The easiest way to reproduce this is to boot an installed system off the Live CD. Start the Live CD and choose "Boot from first hard drive." When the system is started, there will be two copies of the icon for the Live CD on the desktop. You can eject one, but the other one you cannot.
