I have tested the latest upstream kernel 2-3 weeks ago for a different bug, and this bug was still present. Yesterday I uninstalled the kernel as it was worse than the standard one in Ubuntu 13.10 (with all updates), so I cannot tell which version exactly was, it was 3.12.*
