Just upgraded to 13.10 today and noticed this bug still persists. I've tried suspending using the menu as well as closing the lid, and both methods suffer from the HUD being initialized upon wake. My machine is a Dell XPS 13 Ultrabook (128 GB SSD, 4 GB RAM, Sandy Bridge)
