Would it be possible for you to test the latest upstream kernel? Refer to https://wiki.ubuntu.com/KernelMainlineBuilds . Test the 3.9rc8 kernel, not one in the daily directory. Once you have done this, remove the tag "needs-upstream-testing". If this issue exists in the mainline kernel add the tag "kernel-bug-exists-upstream" and if it is fixed, add the tag "kernel-bug-fixed-upstream". If you are simply unable to test the upstream kernel for any reason add the tag "kernel-unable-to-test- upsream". After testing the upstream kernel set the status of this bug back to confirmed. After figuring out if this exists upstream, we will know better where to focus our attempts to get this figured out.
