As this doesn't occur all the time, I am not sure whether it was present in previous releases or not. I can't remember any crash due to sleep/resume in 12.10. But brightness change crash (https://bugs.launchpad.net/ubuntu/+source/fglrx-installer/+bug/1007765) started with 12.04.
