To be sure, I reinstalled everything and got again the latest version from https://wiki.ubuntu.com/KernelMainlineBuilds. I used the version of March 6th, 2013.
In a terminal I checked the used kernel by typing *uname -a.* The used kernel is: 3.9.0.999-generic. The battery design capacity is still 0.
