Yes. It is a commit that adds a special hid driver for this hardware. Before that commit, when the bug is not present, the generic hid driver is used.
So, it's quite possible that the new driver never worked correctly on USB3 hardware. I'd like to see a confirmation from somebody on this bug report about this fix before I contact upstream. I made a ppa where I uploaded a kernel with the patch (version 3.8.0-6.11jelle) to make it easier for people to test. It's stilI building the package at the moment, but I'll verify the ppa myself as soon as the package build is finished.
