@Joseph, I downloaded and have been testing the kernel provided in the link http://people.canonical.com/~jsalisbury/lp1028151/.
I would like to report that the brightness screen does not pop up, and there is no flickering. However, my screen (and system) still freeze. I am going to spend a little more time with that kernel, bc my particular issue only affects my computer after it has been running for a half hour to an hour. That said, as I noted in comment #64, the 3.6 version kernel completely addressed my issue.
