Ok i have just tried to shut down and restart 3 times (of each). It usually did 
it at least 50% of the time. No problems so far. I did not test the upstream 
kernel (should i still test it anyway?) but here is what i did:
1 pressed esc at boot so that it doesnt display the fancy boot logo.
2 swithced to gnome classic and installed synapse 
3 fglrx driver still present
4-is this a unity problem then, in that case should i file a bug under unity???

Also if i dont need to test the upstream kernel what should i add in the
tags area???
