This didn't happen on older versions of Ubuntu (eg. 11.10). I installed the following kernel: http://kernel.ubuntu.com/~kernel-ppa/mainline/v3.3-rc3-precise/ and it *does* happen on this kernel so the flag should be 'kernel-bug-exists-upstream'.
