The hardware has a Broadcom wireless adapter and it is using
"brcm80211", the Broadcom driver in the kernel/staging. It could be of
bad quality in 2.6.38.

can you try to install the proprietary Broadcom driver package "bcmwl-
kernel-source" and see if the issue still occurs with it? Please reboot
and make sure that "wl.ko" is used.
