Un-patched kernel works! I have just installed Guilherme's kernel from http://rookery.ubuntu.com/~kyle/kernels/salgado/2007-04-25/ and the problem went away. Rafael (the patch author) may have been mistaken in thinking that it cannot affect shutdown..
