@Don - Sorry for the late reply. Unfortunately I have no knowledge of how to patch the kernel. Perhaps someone else can help you, otherwise Seth's comment #41 sounds promising. You can monitor www.kernel.org for the release of the 2.6.38.8 kernel, and then after that monitor http://people.canonical.com/~ubuntu-archive/pending-sru.html for the proposed Ubuntu package of the new kernel.
