OK, this is not a bug wrt functionality,
I'm on Kubuntu and via menu
    System -> Adept Manager Manage Packages
and then "Fetch Updates" I indeed get the Upgrade Wizard again.
(Does this correspond to what you call "upgrade button" or "Check"?)

However, for many users the usual way of updating would be to
click on the icon in the panel (I've no idea what that is called)
whenever updates are available.
That icon simply disappears after it's invoked, even if the update
failed on the Upgrade Wizard.
So it would be great if any error message aborting the Upgrade Wizard
would give a hint at how the Wizard can be restarted.
I'm just arguing in terms of usability, because the Upgrade Wizard
is initially invoked automatically, and if it fails that automatic is broken.

As an alternative one might think of marking the state as "updates pending"
in order for the update icon to be kept in the panel.
