I think even if this isn't a bug against the kernel, it's still a bug that leaves a lot of users in the lurch. Maybe rather than marking it as invalid, it would be better to figure out what to assign it to. For many people, for a variety of reasons, patching the source code to their affected applications in order to work with the new serial API semantics isn't an option. Assuming, of course, we're certain this isn't a bug in the kernel.
