I think a packaging bug/request for the firmware should be separate. The kernel option to enable the kernel specific parts and driver is simply a .config oversight on the Ubuntu Kernel maintainers behalf. This driver works well and means users with the card are having to maintain out of tree v4l-dvb kernel tree's on top of the ubuntu kernels, making their systems very unmaintainable.
This is also confirmed as being present in the vanila kernel build options.
