Public bug reported:

Binary package hint: ubiquity

When installing Lucid from the beta 2 desktop image, I had 3 primary
partitions and an extended partition containing a ext3 partition
followed by 60 Gig of unallocated (unformatted) space. I selected "use
largest free space" (or something like that) when asked where to
install, but it complained about not satisfying all constraints and
refused to install. I also tried manual partitioning, and it had a
similar complaint, but I can't remember exactly what the problem was. I
was finally able to install by running gparted, and formatting the free
space to ext4. Then I was able to select the new partition and install
there.

** Affects: ubiquity (Ubuntu)
     Importance: Undecided
         Status: New
