OK, took a quick look at the problem and here's what I found out. The problem is that some entries in the menu (hidden) aren't enabled (sensible) until nautilus has scheduled an update_menus(). Also it's not only about when loading a folder, it could also be if you're selecting a file/folder and then quickly presses ctrl + c/x (also del is affected) it sometimes hasn't updated the state of the menu entries.
Solution?
