This is most likely a kernel bug and would need to be filed in the kernel bug tracker (the Linux one...). For that, we would have to try a really really new kernel first to make sure the bug still exists. I did that at some point to 2.6.32, the bug was still there, but didn't get around to filing it as a kernel bug.
