So it seems that when the driver is loaded and the global rfkill state is enabled then everything comes up ok, when it is soft blocked the hardware block is applied in the device. Strange. Will report to upstreams who pushing this rkfill framework refactor. Could all of you confirm your results with the 2.6.31-3.19 kernel as this is pretty much the tip of mainline for rfkill purposes.
