With mainline kernel 2.6.30-020630rc7-generic I have seen my machine
force the slowst throttling even when connected to mains. Disconnecting
and reconnecting power a few times seems to make it work correctly (note
that when the power is disconnected, the scaling follows the selected
userspace setting for a few seconds before it goes back to the lowest
setting)

Booting back into my old kernel (2.6.28-11-generic) I am seeing the same
behaviour. I suspect that the cpu scaling not adjusting on mains power
is purely because something has not realised that mains has been plugged
back in.

The real problem is that when on battery power, my 2.2Ghz laptop becomes
an 800 mhz laptop which is completely unusable (youtube does not play
smoothly etc).

I need some instructions for how to gather more information on the cpu
scaling, as all I can do at the moment is guess why the kernel has
decided not to increase the cpu speed
