It will disappear after the official kernel upgrade (at kernel.org). Now, it is at 2.6.28.7 released on 20th of February. Ubuntu kernel is based on this 2.6.28.7 (the fact that it is called 2.6.28-10 does not matter)
There is no need to patch it now, since the official update will fix the bug anyway and it will appear in time for Jaunty.
