Yeah i get it too. It is easy to reproduce. Simply 1. install ubuntu 8.10. 2. reboot after it is done. 3. upgrade -> 4. done... you will hit the error that this user has got right now. The issue is that dpkg / the package is not being told to "stop" -> so it can "start" the newer version..... so when the user reboots it is still a problem.
I recommend that the initrd script be fixed immediately to include the case where the package is already installed and running.
