You have a point with that Richard, we accepted the patch after talking
with the artwork guys who recommend it a good workaround for the menus
problem they were pointed and didn't find any good argument to not apply
it. It's not correct anyway as you pointed it and it has been dropped
now with that upload:

 hicolor-icon-theme (0.9-0ubuntu5) feisty; urgency=low
 .
   * debian/patches/01_dont_scale_22x22_apps_icons_for_hicolor.patch:
     - dropped Ubuntu patch, the correct way to do that is to patch gnome-panel
       (Ubuntu: #54713)
   * Sync with Debian
   * New upstream version

We will fix that from gnome-panel that cycle (either by new upstream
version if they do the changes for it or by patching it)
