We had the same problem on Production (eating up filehandles). We gracefully restart our Apaches every 10 mins with a script to modify loadbalancing weights. You can imagine how often we ran out of filehandles. Applied the Patch and it works great! We use mod_jk-1.2.5/Apache 1.3.28 together with Tomcat 3.3.1a On a cluster of several Solaris 9 boxes.
