Linux with Apache 2.0.40? RH 9 by any chance?
Redhat 8.0 and 9.0 use a modified 2.0.40 Apache.
In fact it's a 2.0.40 with many security fixes back ported but the configure/apxs is still 2.0.40 based ;(
