He says you can do whatever you want with his code. How is that not clear?
You can certainly "legally" create a dependency on his code (I would suggest
only in library...(.jar) form) and Tomcat. I don't see a reason why you need
to check his actual code into CVS though. Just check in the .jar file. :-)
