Well that says that spamassasisn is already running on your server.

If you do a netstat -antlp you should get information on the name of what is running on that port. That should give you some clue.

Not sure if you are saying you checked if it works or not and it isn't, or if you are asking for a way to check it.

To check it you can review your /var/log/spamd/current file and see if spam checkups are being logged there.
