The problem is how you quote the filter inside the macro.  Use the 
tripled-quotes like this:
\define getWithStatus(myStatus)
<$list filter="""[all[tiddlers]contains:status[$myStatus$]]""" />
\end

Then, the value of $myStatus$ can contain quotes without a problem.
