IMHO better be explicit if you want to be sure. If the "default" (by law) is dependent on other ways (like the presence of a footway) it will be too complicated for almost every (at least) existing application to understand (also because you won't be sure if the ways are parallel or are maybe at different levels separated by a retaining wall etc.). cheers, Martin
