If the public footpath is cropped i.e. the crop is growing on the path then the farmer is in breach of the Highways Act and the Highways Authority should be informed. Mine operates a 'three strikes and out' policy i.e. magistrate court after two warnings (and the path cleared by the Council at the farmer's expense). I don't usually record the surface of the path in cases like these but do usually add a note that the path was cropped and the date.
