If you use a proper “remote fuel fill station” then it has a camlock to seal against the fuel fill hose and valving to keep fuel from pouring back out and even a small sump for any small amount of fuel that gets spilled. So, yes, the fill station can be below the fill inlet of the tank. There will be fuel trapped in the piping between the remote fuel fill station and the tank though. But I don’t see that being any more of a concern than the fuel that is constantly trapped in the supply and return lines between the tank and pump.
We do it a lot in Phoenix where they require remote fuel fill stations for diesel tanks. Generally we use Pryco, but I think Simplex makes one as well. Phoenix requires a 90% fill alarm at the panel and a solenoid valve in the line that automatically shuts off to prevent overfilling of the tank. So, I know it works from a practical standpoint. If there’s a code requirement that says otherwise, then it must not be enforced here.
