While the confirmed opt-in _is_ the gold standard for lists, most consumer types will find it cumbersome and confusing no matter how easy you make it or how you word it. What this translates to is something on the order of 20%-30% of the people that sign up for consumer lists will never confirm, and it can be higher depending on the targeted audience. For technically inclined people it is still in the 10% range that never do it. Marketing people hate losing (and potentially P.O.-ing) customers who just want to get some information.
